These Terms and Conditions ("Terms") outline the agreement between Ben Richards Studio Limited t/a Views from Japan ("we," "us," "our") and any individual ("you," "the Traveller") who purchases, books, or otherwise engages with the goods and services made available to you via our website, including but not limited to:
      1. Purchase of Views from Japan books and eBooks (“Books”); and
      2. Participation in Views from Japan Planning Sessions (“Planning Sessions”) each a “Product”.

1. Your acceptance of these Terms
   
   1. By accessing and using this website, placing an order for a Product or otherwise using our services, you agree to be bound by and to act in accordance with these Terms.

1. Changes to these Terms
   
   1. We reserve the right to amend these Terms from time to time by amending this page. The amended Terms will be effective from the date they are posted on the website.

      1. We provide curated travel recommendations via our Products based on our own experience of travelling in Japan. Any information, recommendations or opinions provided via our blog, Products and/or any direct communications are for guidance only.

   1. Information, recommendations or opinions provided or on our Site or in our Products should not be taken as any advice, representation, or arrangement by us.
   2. Any information, recommendations or opinions provided via our blog, though our Products or via our direct communications to you are provided “as is” for guidance only and do not constitute professional advice. You are responsible for the decisions you make and we are not liable for anything that happens as a result of you relying on any information, recommendations or opinions provided by us.
   3. Any travel-related decisions taken by you are your sole responsibility and by agreeing to these Terms you agree that Views from Japan shall bear no responsibility for any travel-related decisions you make.

1. Orders, payments, cancellation, refunds and delivery
   
   1. Orders
      
      1. When you place an order for a Product, we will acknowledge it by email. The acknowledgement does not, however, mean that your order has been accepted by us.
      2. We will only accept your order when we email you to confirm this (“Confirmation Email”).

1. Payments
   
   1. We accept payment by the following credit cards and debit cards: Visa, Mastercard and American Express. We also accept payment via Apple Pay and PayPal. We do not accept cash or cheques.
   2. We will do all that we reasonably can to ensure that all of the information you give us when paying for the Products is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, any failure by us to comply with these Terms or breach by us of our duties under applicable laws, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.
   3. All prices are in pounds sterling ($)(USD) and include VAT at the applicable rate, but exclude delivery charges (where applicable).

1. Traveller responsibilities
   
   1. Sustainability of Products
      
      1. Any information, recommendations or opinions provided via our blog, though our Products or via our direct communications to you are provided “as is” for guidance only and do not constitute professional advice.
      2. You are responsible for the decisions you make and we are not liable for anything that happens as a result of you relying on any information, recommendations or opinions provided via our blog, through our Products or via our direct communications to you.

1. Travel-related decisions
   
   1. Any travel-related decisions taken by you are your sole responsibility and by agreeing to these Terms you agree that Views from Japan shall bear no responsibility for any travel-related decisions you make.

1. Travel insurance
   
   1. It is the Traveller’s responsibility to arrange and purchase comprehensive travel insurance to cover all potential risks, including medical emergencies, trip cancellations, lost baggage, or other disruptions.

1. Immigration and entry
   
   1. The Traveller is responsible for complying with Japan’s immigration policies. Failure to comply may result in denied entry, and we accept no liability in such cases.

1. Personal health and safety
   
   1. Travellers with allergies, mobility issues, or specific requirements may choose to disclose these to us prior to or during the Planning Sessions but you are by no means required to do so.
   2. You are solely responsible for all travel-related decisions, including but not limited to ensuring that you have adequate arrangements in place to cater to any specific requirements you may have.
   3. We do not provide medical or emergency support. All medical assistance and related costs are the sole responsibility of the Traveller.

1. Limitation of liability
   
   1. We are not legally responsible for:
      1. losses you may incur in the event that any Product does not meet your requirements or is not suitable for you;
      2. losses that were not foreseeable to you and us when the contract was formed;
      3. losses that were not caused by any breach on our part;
      4. trip disruptions, service quality (save for our own), cancellations, or other issues related to bookings made through any third-party providers; business losses; or losses to non-consumers.
   2. The Traveller accepts any possible risks and assumes full responsibility for any loss, injury, or damage not directly caused by us.
   3. We do not give any warranty that this website is free for viruses or anything else which may have a harmful effect on any technology.
   4. Our liability to you in connection with these Terms shall be limited to the price of any Purchases made by you directly from us.

1. Third-party providers and disruptions
   
   1. Our responsibility
      
      1. We do our very best to recommend reputable and trusted suppliers to ensure an exceptional travel experience. However, we are not responsible for delays or issues not caused by us or that are outside of our reasonable control.

1. Force Majeure
   
   1. We are not liable for delays, cancellations, or service interruptions due to events outside of our reasonable control, including but not limited to:
      1. natural disasters (earthquakes, typhoons, floods, etc.);
      2. war, riots, or civil disturbances;
      3. pandemics, epidemics, or government-imposed travel restrictions; or
      4. strikes, industrial actions, or supplier failures.

1. Intellectual Property
   
   1. “Intellectual Property Rights” means any and all intellectual property rights including trademarks, copyright, moral rights, database rights, know-how and all other intellectual and proprietary information rights as may exist now or hereafter come into existence; all modifications, renewals, rights to apply for, renewals and extension of any of the foregoing arising under the laws of any country, state or jurisdiction in the world.
   2. Any Intellectual Property Rights subsisting in the Products is and shall remain our sole property. You acknowledge that all present and future rights in and title to the Products, including the right to grant access to and use of the same, shall vest in us.

   1. We may use your personal data to send you updates by email about our Products, including exclusive offers, promotions or new products and/or services.
   2. You have the right to opt out of receiving marketing communications at any time by contacting us at info@viewsfromjapan.com
   3. We may ask you to confirm or update your marketing preferences if you ask us to provide further products and/or services in the future, or if there are changes in the law, regulation, or the structure of our business.
   4. We will always treat your personal data with the utmost respect and never sell or share it with other organisations outside the Views from Japan group for marketing purposes.
